Are brokers allowed to represent themselves as parties to a deal?

    Ali Faizan Syed1 min read0 viewsUpdated 1/2/2026
A broker is generally prohibited from holding themselves out as a party to the contract they are brokering. The only exception is if they are expressly authorised by the contracting parties to do so. However, if a broker becomes a party to the contract, they forfeit their right to any fees for that transaction. This rule prevents conflicts of interest and ensures that the broker's advice remains objective and focused on the clients best interest.
