    What happens to an easement if a dominant property is subdivided?

    If a dominant Real Property Unit that benefits from an easement is subdivided, the legal protection of that right continues. Each resulting part of the subdivided unit will continue to have an easement over the servient unit. However, this is subject to the condition that the subdivision does not increase the burden on the servient property. If the easement only benefits certain parts of the new subdivision, the servient unit owner can apply to the DLD to have the easement extinguished for the other parts.
