    How are area shortages in off-plan units handled legally?

    Article (12) states that the area of a sold unit is generally deemed correct, and developers cannot charge for excess area found after handover. However, if there is a shortage in the area, the developer must compensate the purchaser. According to the implementing bylaw, this compensation is only mandatory if the shortage exceeds five percent (5%) of the net area. In such cases, the refund is calculated based on the unit price agreed upon in the original sale contract.
