    Can a developer change the project site boundaries?

    If a Master Developer makes variations to a project site that change its boundaries and area, this is legally recognized as a factor beyond the Sub-developer's control. If such changes affect the Sub-developer's ability to perform their obligations toward purchasers, it may excuse them from certain negligence claims. However, any amendment to a Master Community Declaration that affects purchaser rights must first be approved by RERA to ensure the interests of the unit owners are not unfairly compromised.
