What happens if a developer terminates a contract for an unstarted project?

If the implementation of a project has not yet commenced for reasons beyond the developers control, specific rules apply to contract termination. In this scenario, the developer is permitted to retain up to thirty percent (30%) of the amounts already paid by the purchaser. However, the developer must prove they have fulfilled all their obligations and that the delay was not due to negligence or omission. The developer must then refund any remaining balance to the purchaser within sixty days.
