    Must a mortgage be registered to be legally effective?

    Article (7) of Law No. (14) of 2008 explicitly states that a mortgage only comes into effect if it is registered with the DLD. Any agreement that attempts to create a mortgage without registration is considered null and void. Generally, the Mortgagor is responsible for paying the registration fees unless the parties agree otherwise. This mandatory registration ensures that the mortgage is a matter of public record, protecting third parties and establishing the legal priority of the lender.
